These are the terms and conditions acts as a guideline and agreement  between Passengers, drivers and our company, Cabme Nig. LTD, a private Limited Liability company under CAMA 2020 (As amended)

TERMS AND CONDITION (DRIVER)

1. CONTRACT OF SERVICE

These Terms of Use (“Terms”) govern the access or use by you, an individual who is affiliated and associated with Cabme Nig. Ltd; it is pertinent to know that these terms and conditions of usage will govern any existing contractual relationship existing between all parties from within and outside Nigeria. Accordingly, for any existing contractual relationship between both parties, every driver associated with CABME NIG LTD are INDEPENDENT THIRD-PARTY CONTRACTORS WHO ARE NOT EMPLOYED FULLY OR PARTLY BY CABME.NIG.

 CABME NIG DOES NOT PROVIDE TRANSPORTATION OR LOGISTICS SERVICES OR FUNCTION AS A TRANSPORTATION CARRIER, AND THAT ALL SUCH TRANSPORTATION OR LOGISTICS SERVICES ARE PROVIDED BY INDEPENDENT THIRD-PARTY CONTRACTORS WHO ARE NOT EMPLOYED BY CABME OR ANY OF ITS AFFILIATES OR ASSOCIATES, this measures will apply especially in issues of safety , security and  liability as such  shifts to this INDEPENDENT THIRD PARTY CONTRACTORS (DRIVERS)

2. HOW WE OPERATE

The Services constitute a computerised device application software which acts as a platform that enables users of CABME NIG. mobile applications or websites provided to gain access to transportation and logistics purposes, drivers who are independent contractors who are registered with the company. Passengers and drivers are informed of the usage of the application for transportation and logistics.

For passengers who book for a ride through the application software, the application provides amounts which are carefully assessed and calculated with existing kilometres and times afforded for such trips.

Time used will be in SECONDS, MINUTES AND HOURS for such a trip.

Drivers should act in every sense of decorum and MUST do so carefully.

Independent contractors (drivers) are ambassadors of the company; their actions or inaction affects the reputation of the company. They are to be respectful to their passengers at all times.

3. SCRUTINY AND LICENSE PROVISION

As INDEPENDENT CONTRACTORS of the company, drivers are subjected to comprehensive scrutiny before they can be in operation with the company.

Before licences are giving to these individual contractors, parties will be subjected to scrutiny such as

a. INSPECTION: After advertisements and publications are made, which can be assessed with the use of the mobile app and any form of physical publication, CABME NIG has the exclusive discretion to invite any driver whom it deems fit for his/her vehicle inspection. The company will carefully inspect the condition of the vehicle, the mileage, and the title of vehicle ownership, whether it is personally gotten by such an individual or given to him/her by a third party for such a purpose for it to be used for ride and cab purposes. CABME NIG will not be held responsible and liable if the vehicle was purchased through an illicit or fraudulent act.

b. PROVISION OF A GUARANTOR: Policies consummated with the CABME NIG as a company is to see that both the drivers and passengers are provided with security within their limit. Thus, independent contractors will have to get themselves a guarantor that will act as a shorty between these individual persons and the company.

NB: Accepted Guarantors: Lecturers, Architects, Engineers, Teachers, Doctors, A Reputable Business Owner, Nurses, Lawyers, Bankers, Accountants, Managers/Deputy Managers of reputable companies/establishments, Traditional rulers and Clergy from well-recognised churches/mosques, and Senior Civil Servants not lower than Grade Level 8 excluding uniform personnel.

GUARANTOR FORMS WILL ALSO BE PROVIDED BY THE COMPANY TO THESE INDEPENDENT CONTRACTORS

c. FORMS ACTING AS SECURITY MEASURES

In order to provide security precautions for and in the interest of the company, forms will be provided in the company's headquarters in AWKA, AWKA SOUTH L.G.A., ANAMBRA STATE, NIGERIA. Unless in the long run another address is provided, the forms will contain details of this individual, address, and means of identification, as the company will also provide its identification card issued to this individual when it his/her application has been accepted. Forms will be duplicated into various copies and submitted to various agencies, either government-established agencies or private agencies in association with the company.

4. SECURITY PRECAUTIONS:

Inasmuch as CABME NIG is a channel that links both the independent contracted drivers and the passengers, CABME NIG can only use the necessary available information from the mobile application through the passengers' and drivers' profiles, respectively, on the application.

Cabme Nig does not have a superficial link or association with their passengers or drivers alike, Independent contractors (drivers) MUST be vigilant of any passengers/drivers that intend to ride with them and vice versa.

NOTE: SAFETY GUIDELINES in the cause of your interview with the company will be provided, which will contain issues you should look out for before deciding to pick up passengers. In situations of any illegality and unlawfulness by such passengers, the driver should exercise reasonable discretion by ending the trip and reaching out to the customer care service and/or relevant law enforcement agencies.

It is worthy to note that it falls within the exclusive right for the company to decide if such trip cancellation was the best decision that would have been taken in such circumstances.

CABME NIG will either approve such an excuse or decide to penalise such drivers as the circumstances of the case permit.

5. DISCLAIMERS; LIMITATION OF LIABILITY; INDEMNITY.

CABME NIG will not be responsible for any property stolen or obtained or act giving rise to theft or any other illegal and unlawful misconduct, action and inaction committed by such passengers in the course of riding this passenger. CABME NIG will only give safety tips, and in the case of stolen property, the company can help to provide necessary information within its disposal. Such as information gotten from the passenger's profile and also help in providing this relevant information which will act as a guide to apprehend those perpetrators.

6. ACT OF INSUBORDINATION AND NEGLIGENCE;

What is termed 'insubordination' and 'negligence' falls within the exclusive rights of the CABME NIG LTD and the laws. Insubordination and negligence, depending on the extent of such, have penalties for such defaulters.

NOTEWORTHY: Inasmuch as such drivers are independent contractors, they are still ambassadors of the company, and they must act in such manner and conduct that would portray the company in a positive light to any passengers.

ACT OF INSUBORDINATION AND NEGLIGENCE ARE OUTLINED BELOW;

A. ACT OF DELAY IN EMBARKING ON A TRIP; 

Drivers are not allowed to delay their respective trips unless it is coming from the passengers. CABME NIG regulates time and the kilometres covered. CABME NIG, in partnership with the GOOGLE MAP APPLICATION, has a designated time interval when such a trip commences and when it ends. Any contrary time spacing is completely annulled, and such drivers will be duly sanctioned, as there are regulated defaulter fees which must be paid before the company will continue doing business with such drivers.

B. UNPRECEDENTED AUTHENTICATION  

This can be viewed as an insubordination to the company; the drivers are not allowed to involve themselves in any form of heated argument with their passengers. If any form of heated argument occurs, such drivers have the right to report immediately to the CABME NIG customer care providers, and advice and immediate intervention on possible measures will therefore be provided to avoid such an event.

 C.   JOBS DONE OUTSIDE DUTY OF THE COMPANY;

This particular subsection depends on the context in which the work was done.

CABME NIG does not prevent drivers from carrying out their personal day-to-day driving job; however, if the passengers are passengers who had earlier booked his/her ride with CABME NIG as a company, drivers in this context are not allowed to accept bookings from them, as they are foreclosed from the same during, within and 5 years after such a drive quits using the Cabme Nig application software.

Any personal ride with such a passenger, in this context, is seen as gross insubordination.

Drivers (independent contractors) will be dismissed from using and accessing our application and will pay a fine. Drivers should always inform their passengers of actions such that they amount to insubordination and the same are not condoned by the company.

D. CRIMINAL ACTS 

Acts such as sexual immorality, sexual advancement, acts of bodily harm and theft of property, kidnapping and all or any illegal and unlawful acts whatsoever are unlawful, and the company will never involve itself in such practices and will help the relevant authorities to provide information for the arrest and prosecution of such drivers and, in addition, a final dismissal of such drivers from the company and access to the company's mobile application software.

E.   INAVAILABILITY OF DRIVER

A driver should make himself available anytime of the day, as the APPLICATION runs 24 HRS, except the driver has elected the time of the day he desires to be available, and such time must be duly communicated to the company management team in writing.

Any driver who goes incommunicado except for unforeseen circumstances that led to the absence of such a driver may be deemed non-diligent, and a possible decision for removal may follow suit as the case may be. Unforeseen circumstances such as health issues, marriage, burial rites and long-distance travel and such distance will be reasonably fair.

7. DISPUTE RESOLUTION AND CONFLICT

All grievances will be directed to the ADR (ARBITRATION AND DISPUTE RESOLUTION) procedure.

8. PAY/COMMISSION

All payments are generally paid directly to the company mobile application of CABME NIG, which are regulated via time and Kilometer coverage. no driver is allowed in any manner to receive any monies whether by cash or transfer, without the authorization from the company, failure to adhere to this instruction, the company will treat such person will be treated within the ambit of the law.

Drivers are after each trip entitled to their commission, which the CABME NIG mobile app will provide an e-wallet for, and the mode of use will be well informed to such drivers as well as the time for withdrawal of such commission by the company management team. 

9. RESTRICTIONS IN SERVICE

You may not: 

(i) Remove any copyright, trademark or other proprietary notices from any portion of the services. 

(ii) reproduce, modify, prepare derivative works based upon, distribute, license, lease, sell, resell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Services except as expressly permitted by CABME; 

(iii) decompile, reverse engineer or disassemble the Services except as may be permitted by applicable law; 

(iv) link to, mirror or frame any portion of the Services; 

(v) cause or launch any programmes or scripts for the purpose of scraping, indexing, surveying, or otherwise data mining any portion of the Services or unduly burdening or hindering the operation and/or functionality of any aspect of the Services; or 

(vi) attempt to gain unauthorised access to or impair any aspect of the Services or its related systems or networks.
